In March 2012, they offered another deal that would have made him the highest paid player in the league.? In June 2012, they upped the ante once again.

So where?s the bad faith?

Not giving a guy everything he wants isn?t bad faith.? Not blowing out a team?s salary cap for one player isn?t bad faith.

If the Saints aren?t happy with their most important player because of his role in the labor talks, then the other 31 teams presumably like him even less.? With coach Sean Payton suspended for the year and with the franchise otherwise in disarray, Brees? presence during the entire offseason program should have been regarded as critical to a successful effort in 2012 ? especially since the Saints? postseason performance hinges on home-field advantage unlike any other team in the league.

The Saints also had been leaking that Brees wants more money than he actually has demanded.? Stupid, yes.? Bad faith, no.

The Saints need Brees.? The Saints love Brees.? But his role in the CBA talks is irrelevant to the ongoing inability to work out a long-term deal, and Brees knows it.

Cablevision launches iOS app to track down Optimum WiFi hotspots, keep you off the 3G sauce

Some internet purveyors make a big fuss over having public WiFi. It's not often that they go out of their way to help you find that WiFi, however, and that's where CableVision's recently posted (but just now official) Optimum WiFi Hotspot Finder comes in. If you're one of the cable company's Optimum Online subscribers, the currently iOS-only app will pinpoint the 35,000 access points that you can call a home away from home. As we'd hope, the app both finds hotspots nearby for an immediate fix or drills down to specific hotspots if you're just that determined to find a restaurant with a data pipe. The app and WiFi access are both free -- apart from that small matter of the cable account, of course -- and will no doubt help iPad and iPhone owners for whom Optimum WiFi's 15Mbps speed is an oasis in a sea of pokey 3G.

Understanding Senior Care and Elder Law











Senior care and elder law are closely related industries that seek to provide care and protection for one of our most vulnerable populations -- senior citizens. But while distinctly different, senior care and elder law often intersect when it comes to the needs of our aging family members. Understanding what each is and how it can help your elder loved one can significantly improve the lifestyle of your entire family.

Senior care is a healthcare field dedicated to providing basic assistance and medical care for seniors. The field broadly refers to three primary types of care:

In Home Care -- The type of care that allows for the highest level of independence, in home care is provided by skilled professionals in the home of the elderly person. This can include full time, part time or relief care services.

Assisted Living -- Assisted living generally refers to a community designed, built and managed in such a way as to provide long term support to seniors. Members of assisted living communities often live in their own apartment or condominium and have access to a variety of senior care services.

Nursing Care -- Nursing care is the most intensive level of care and offers full medical services including medication management. Nursing care residents live in a specialized facility staffed by nurses and their aides, and in some cases psychiatrists and medical doctors are part of the regular staff.

Elder law is a relatively new field of law that deals exclusively with legal issues related to senior citizens. This includes estate planning, wills and trusts, laws dealing with insurance and medical care, and laws that protect the elderly from neglect or abuse.

Senior care and elder law intersect in the following 2 ways:

1.) Life Decisions

There are complicated laws surrounding legal issues like wills, long term care and estate planning. These laws require legal counsel even in the most ideal situations, but what often happens is that families begin asking about these laws only after a crisis has occurred.

For instance, in the case of an elderly family member suddenly taking ill and being unable to make their own rational decisions, legal intervention is often required in order for long term care to proceed. And in cases of dementia where family members want to provide care at home; there are legal responsibilities that must be undertaken when doing so.

The best solution to these problems is to create a plan before crisis occurs.

2.) Protection from Abuse

It's unfortunate that we would need them, but there are laws in place that protect seniors from neglect or abuse. In many cases the punishment for violating these laws are severe and come with hefty prison sentences. Family members that suspect their loved ones are being mistreated can take action by invoking elder law. Authorities are required to rigorously investigate any such claims.

Care to Wager on the Supreme Court's ACA Ruling?

Some people can?t wait for the U.S. Supreme Court announcement of its ruling on the Obama Administration?s Affordable Care Act (aka health care reform law), so they are betting on the outcome.

Intrade, a popular online trading exchange, provides a platform for people to wager on whether or not future events will happen. More than 21,000 people have put money on the following: ?The U.S. Supreme Court to rule individual mandate unconstitutional before midnight ET 31 Dec 2012.? As of this writing, Intrade gives a 74.4 percent chance that the mandate will be struck down.

The Dublin-based site lets individuals buy shares if they think an event will happen and sell if they think it won?t. Events have defined end points. For example, if the Supreme Court rules the individual mandate unconstitutional, all shares will jump to $10 each and shareholders will be paid. If the opposite ruling is handed down, the shares will settle at $0. The site posts a probability of an event happening by converting share prices into a percentage. When shares of the Court?s ruling were selling at $7.81 per share, the probability was 78.1 percent.

The Supreme Court ruling event is one of the most active on the site this week. Other hotly traded markets are ?Barack Obama to be re-elected President in 2012,? a corresponding market for Mitt Romney, and ?Will the U.S. economy go into recession in 2012?? The site goes beyond politics, too, speculating in categories such as climate and weather. For example: ?Arctic sea ice extent for Sept. 2012 to be less than 4.3 million square kilometers.? Entertainment is fair game as well: ?The Dark Knight Rises to gross OVER $175.0M in opening weekend.?

Bettors on Intrade took a stab at the outcome of the U.S. presidential election in 2008, predicting electoral college votes almost exactly: They missed one of Nebraska?s votes, and forecast that McCain would win Indiana and Obama would take Missouri.* The two states each went to the opposite party, but their electoral vote tallies canceled out and InTrade?s prediction was nearly spot on. The site also boasts 97.89 percent prediction accuracy for the 2012 Academy Awards. For the movie industry?s big night, bettors traded almost $1.3 million and the winningest individual made $22,133.

Will the site?s Affordable Care Act prediction hold true? Less wager-happy spectators can simply await the court?s decision.

What Would Health Insurance Cost if the Supreme Court Overturns the

That will be the big question on Thursday if the Court throws out the mandate and the parallel insurance reforms that would require health plans to take all comers without regard to their health status and require insurers to cover pre-existing conditions.

But before we get to that scenario, let?s look at another possibility.

The Court Overturns Both the Individual Mandate and the Insurance Reforms
First, if the mandate were to be thrown out, and with it the insurance reforms, the impact on the health insurance companies would only be positive?there would be no ?adverse selection? from only the sickest buying insurance. Insurance companies could continue to underwrite--decide who and who not to cover--but would have the federal government spending $50 billion a year under the surviving parts of the Affordable Care Act (ACA) giving consumers subsidies with which to purchase their insurance plans.

On the surface, that would be a great thing for the health insurance business. It might even mean lower prices than those we have today, as millions of healthy people would be subsidized to enter the insurance pool.

However, these subsides would not be available until January 1, 2014. In the meantime, Democrats would do all they could to reinstate the insurance reforms and try to implement one of the alternatives to the individual mandate.

Republicans would do all in their power to ?repeal and replace? the rest of the Affordable Care Act in the wake of what they hope will be an election victory this November. With control of the House, a minimum of 51 votes in the Senate, and Romney in the White House, Republicans would at least gut the remainder of the ACA, irrespective of what they might do to ?replace? it. The insurance premium subsides would be the easiest thing to get rid of under Senate budget rules.

The only way I see insurance companies benefiting from a Supreme Court ruling that would toss the mandate, as well as the insurance reforms, is if the Congress later couldn?t agree on how to fix or repeal the ACA and the circumstance neither side supported continued indefinitely.

The Court Overturns the Individual Mandate and Keeps the Insurance Reforms in Place
The most problematic outcome would be if the Court only struck the mandate but allowed the insurance reforms to continue in place. In this case, insurance companies would be required to cover everyone?both the sick and the healthy. While there would likely be some administrative limits on when people could buy health insurance, consumers could generally wait until they were sick to get covered.

In a recent study, Larry Levitt and Gary Claxton at the Kaiser Family Foundation said, ?It?s pretty clear that in a system like that, sicker people would be more likely to buy insurance, and premiums would rise as a result.?

But the authors went on to argue that, ?It is by no means inevitable that the individual market will enter a death spiral.? They rightly point out that the ACA, unlike past state efforts to reform the insurance market, will grant subsidies to millions of people making coverage affordable for them.

As I have said on this blog a number of times before, a mandate is not needed if affordable health insurance is available. There is currently no mandate that employees buy insurance when it is offered at work yet we have an excellent cross section of risk in the employer health insurance market. The same is true in the Medicare Part D drug program where seniors have the option of buying the drug plan.

But, while there is no mandate in employer-based coverage, if a worker declines the coverage they and their dependents would be subject to a pre-existing condition limitation if they later choose to buy (both a protection for the insurance company and a penalty for the consumer)?not the case under the ACA. In Medicare Part D, late enrollees are penalized by paying higher premiums, something also not a part of the ACA.

The bigger problem is that while the ACA?s subsidies are very good for low-income people, they are far from adequate for the middle class?particularly families.

As the Kaiser study pointed out, the Congressional Budget Office (CBO) has estimated that about half those in the individual market will be eligible for a subsidy under the ACA.

I will suggest that what is critically important here is that those not getting a subsidy, or at least a big subsidy, are the ones the mandate was directed at in the first place.

Families making $20,000, $30,000, $40,000, or even $50,000 a year were always going to get a big percentage of their health insurance paid for under the ACA. For example, a family of four making $55,000 a year would pay about $400 a month for their insurance?close to what most families in employer plans now pay. Families making less would have much better subsidies?a family at 150% of poverty would only pay 4% of their income for health insurance under the ACA.

But families making 300% to 400% of the federal poverty level would have to pay 9.5% of their incomes for health insurance?a $60,000 family would have to find $5,700 in their already tight annual budget. Families making more than 400% of the poverty level would have to pay the entire cost of health insurance?which today averages $14,000 a year in employer plans.

There is another wild card?the ACA caps the premium older people would pay at three times the premium the youngest people would pay?it is often 5:1 today. The Kaiser study argued that this would help the younger and healthier buy coverage. That is true--presuming this insurance reform doesn't get tossed by the Court with the other insurance reforms. But I will also suggest the younger are more often the lower income people and that the tighter age bands in the ACA will make it even more expensive for older people to be able to afford coverage?more often the sicker part of the population that would gain from entering and exiting the market when it would be most convenient for them to do so.

There are a number of estimates that say without a mandate individual health insurance would cost 10% to 40% more.

The CBO has said that without a mandate 16 million fewer people would be covered and premiums would be 15% to 20% higher.

That looks to me to be the best case.

In practical terms, that could be $1,500 to $2,000 more each year in higher premiums for a young family and $3,000 to $4,500 a year more for older people.

Having a health insurance market that provides guaranteed health insurance at these costs is hardly a sustainable situation. And if history is the guide, high insurance rates the first year only get higher each subsequent year as fewer and fewer healthy people see the value in coverage.

I would also suggest there is another wild card, presuming the Republicans don't repeal the ACA, that could impact either of these Supreme Court scenarios?the states.

?Blue States??those having a Democratic governor and legislature?could well fill the vacuum created by any Supreme Court ruling. With $50 billion in annual federal health insurance subsidies in the market starting in 2014, a state could enact a mandate as well as insurance reforms in the wake of a Supreme Court ruling against the law.

Ironically, most states have not been able to do health care reform largely because they don?t have the money. But if the bulk of the law, and particularly if the subsidies remain, they would have the money and the legislative power to pass an individual mandate, or more likely one of the alternatives to the mandate, and reform the individual and small group health insurance market.

That could be a very potent combination for those largely ?Blue States? that are building insurance exchanges.

But in the end, what would health insurance cost if the Supreme Court overturns the individual mandate but leaves the insurance reforms in place?

A lot more than most people, who didn't have plenty of government assistance, could afford.

But you know what? The Supreme Court ruling, whatever it is, will likely be small potatoes compared to what the November elections could do to kill or preserve the Democrats' Affordable Care Act well before January 1, 2014.

Suicide Prevention Gatekeeper Training: summer sessions

Did you know you?re more likely to interact with a student in emotional distress or experiencing a suicidal crisis than a student in cardiac arrest or choking?Suicide is the most preventable form of death, yet it is a leading cause for students.Eight out of 10 people considering suicide give some sign of their intentions. This is your opportunity to learn to intervene!

You don?t have to be a mental health professional intervene. When you go through Suicide Prevention Gatekeeper Training with Jennifer Myers, Coordinator of Suicide Prevention Services at Student Health Services Counseling & Human Development Center, you will become trained to serve as a ?gatekeeper? to mental health services on campus and in the community. As a member of our campus community, you can play a vital role in assisting a struggling person get the help they need.

?

When you become a Gatekeeper, you:

? Enhance your awareness, knowledge and skills concerning college student suicide

? Learn the signs to identify students at risk and how to connect a student with the appropriate service

? Improve your skills and gain confidence in your ability to intervene

? Become informed about mental health resources on campus

Think you have a sluggish metabolism?

Find out for sure by having your resting metabolic rate (RMR) measured. The Student Health Services Campus Wellness registered dietitians have a great tool?MedGem?that measures RMR. The results?your specific metabolism?will help the dietitian determine exactly how many calories you really need for adequate energy and weight control.

?

Your RMR is the amount of calories you burn throughout the day in order to function properly. In essence, it is the minimum amount of calories a person needs to consume per day. Daily activities will lead to the body burning additional calories, which are not included in the RMR results. Your RMR is unique and can account for up to 75% of the calories you burn each day. The remaining 25% is influenced by activities of daily living and physical activity. Knowing your unique RMR allows you to establish a calorie budget that will help you reach your weight loss goals without the one-size-fits-all approach.

?

For the test, you will breathe into a small, handheld device for 10 to 15 minutes. You will receive your results and an explanation during a one-on-one consultation with the dietitian following the procedure. Testing and consultation will last approximately one hour.

Prior to the test:

????????? Do not eat, exercise or drink caffeinated beverages for 4 hours before the test.

????????? Rest for 10-15 minutes.

????????? Do not consume nutritional stimulants, including ephedra,?Ma Huang or pseudoephedrine for 4 hours before the test.

????????? Do not use nicotine for at least 1 hour before the test.

Schedule a morning appointment with a dietitian for metabolic testing by calling the Thomson Student Health Center at 803-777-3175. There is a $25 fee for students and $75 fee for faculty and staff, which covers RMR testing and the consultation that follows.

European Science Foundation calls for support of social science research in Central and Eastern Europe

Strasbourg, 26 June 2012 - A new forward looking report, 'Central and Eastern Europe Beyond Transition: Convergence and Divergence in Europe', has been published today by the European Science Foundation. The report aims to identify new themes for social science research in and on CEE, which can be promoted and endorsed by national and European funding institutions.

In this forward looking exercise, three interdisciplinary thematic clusters have been identified: Populations in change; New Geographies of Europe; and Social Cohesion. Populations in change aims at looking into how out/in migration, regional population change, ethnic minorities and integration all affect the basic structure of CEE populations. New Geographies of Europe focuses on the 'return to Europe', overcoming the West-East divide, on the influence of cohesion funds on local governance and on the expanding borders of Europe eastwards. Social Cohesion focuses on the degree of socio-economic transformation that post-communist Europe has undergone over the last 20 years, especially in terms of social mobility and social trust.

Peter Weiss, ambassador of the Slovak Republic in Hungary commented: "Rethinking of social science research in and on Central and Eastern Europe, setting new frontiers in social sciences and identifying main research challenges and subjects of cooperation between academics from Western and Eastern European countries is, without a discussion, one of the basic preconditions for overcoming the recent crisis in the EU".

The last 25 years have witnessed some of the most profound political, social and economic changes in Europe's history. The fall of communism at the end of the 1980s not only reshaped relationships within the continent, but also provided fascinating insights into the potential for, and limitations of, the large-scale reshaping of society.

"Social sciences in Central and Eastern Europe were seriously distorted during the communist period." explained Professor Daniel David, vice president of the Romanian Research Council (CNCS). "This Report could help us for integrating social sciences research from Central and Eastern Europe in the international area".

The report also outlines eight structural recommendations for social science research in and on CEE. These underline the need to ensure a stronger presence of CEE scholars and CEE social research issues in international level research projects. They also highlight real needs in terms of the development of research infrastructure and human capital and call for the implementation of good practices in terms of governance, scientific excellence and independence.

"The Forward Look provides a well-elaborated insight and recommendations on the place of Social Sciences and Humanities in Central and Eastern Europe and how these could and should interface with the international research project level" Robert Burmanjer, Head of Social Sciences and Humanities Unit at the European Commission commented.

The report was also praised by Karin Liebhart, president of the Central European Political Science Association: "I'd like to congratulate the entire team that worked on the report at hand. It is an excellent base for further discussion and contains a lot of detailed information and valuable insights."
